Glasschord Magzine collects information from users at several different points on its site, and it is the sole owner of the information collected on this site. We do not sell, share, or rent this information to others in way. The Glasschord Magazine site contains links to other sites. Glasschord Magazine is not responsible for the privacy practices or the content of Web sites that link to or from Glasschord Magazine.

User Information
In order to use some of our services, like leaving comments, users must fill out a form to supply their contact information (e.g., name and email address).

We do not use this contact information in any other way than to monitor users’ posts.

A cookie is a piece of data stored on the user’s hard drive containing information about the user. Sometimes Glasschord Magazine uses cookies for certain features. Cookies on our site are in no way linked to any personally identifiable information. From time-to-time Glasschord Magazine will request information from users via surveys or contests. Participation in these surveys or contests is voluntary. Information requested may include contact information (such as name and shipping address), and demographic information (such as zip code and age). This contact information will be used to notify the winners and award prizes. Survey information will be used to make improvements to our Web site. This information may also be shared with advertisers on an aggregate basis (no individual demographic information will be supplied to advertisers).

Correspondence With Users Through Subscription Process
We send all subscribed users an email confirming their subscription. We also send site and service announcement updates that contain important information about our Web site.

We do not sell, rent or otherwise provide our registered users email addresses to third parties.

This site makes commenting available to its users. Note To Parents
At Glasschord Magazine we are aware that many children may want to visit us on the internet. Although we welcome browsing, we encourage children to receive permission from their parents before submitting any personal information over the internet. Glasschord believes parents should be responsible for supervising the online activities of their children and taking into account various tools that allow them to provide their children with a controlled, child-friendly internet. These tools are designed to preclude children from releasing personal information online without the permission of their parents.

Our privacy policy is posted in the “About Us” and “Subscribe” section of our site. If at any point we decide to use personally identifiable information in a manner different from that stated at the time it was collected, we will update our privacy policy and notify our subscribed users via email.

TERMS OF USE AGREEMENT

Effective Date: This Terms of Use Agreement (the “Agreement”) was last updated on May 25th, 2011.

This Terms of Use Agreement sets forth the standards of use of the website at www.glasschord.com (the “Site”) operated by Glasschord Magazine (“Glasschord” or “we” or “us”).  By using the Site to submit your work, you agree to these terms and conditions. If you do not agree to the terms and conditions of this Agreement, you should immediately cease all usage of the Site. We reserve the right, at any time, to modify, alter, or update the terms and conditions of this agreement without prior notice. Modifications shall become effective immediately upon being posted to the Site. Your continued use of the Site after amendments are posted constitutes an acknowledgment and acceptance of the Agreement and its modifications. Except as provided in this paragraph, this Agreement may not be amended.

Limitation of Liability
Glasschord shall not be liable for any damages whatsoever, and in particular Glasschord shall not be liable for any special, indirect, consequential, or incidental damages, or damages for lost profits, loss of revenue, or loss of use, arising out of or related to the site or the information contained in it, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise. Some jurisdictions do not allow for the limitation or exclusion of liability for incidental or consequential damages; therefore, some of the above limitations may be inapplicable.

Indemnification
You agree to indemnify and hold Glasschord and its members harmless from any claim or demand, including attorneys’ fees and costs, made by any third party due to or arising out of your use of the Site, the violation of this Agreement, or violation of any law by you.

Compliance with Laws
You assume all knowledge of applicable law and are responsible for compliance with any such laws. You may not use the Site in any way that violates applicable state, federal, or international laws, regulations or other government requirements. You further agree not to transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable local, state, national, or international law or regulation.

Copyright and Licensing Information
By submitting to Glasschord works of art in the form of any medium for publication on the Site (“Art”), you warrant and represent that you own all rights, including but not limited to all U.S. copyright rights, in and to the Art. You grant to Glasschord the revocable right and license to publish the Art on the Site.

All published Art is marked with a Creative Commons or Copyright Restricted license. At the time of submission, you have the option of choosing between one of three Creative Commons licenses: (1) attribution non-commercial; (2) attribution non-commercial – share-alike; and (3) attribution non-commercial – no derivatives, or a Copyright Restricted License. If you do not choose a license for the Art you are submitting, that Art will be marked with a default Creative Commons license: attribution non-commercial – share-alike. If you wish to change a license post-submission, please contact info@glasschord.com.

To the extent that you do not own all rights in and to the Art or that Glasschord’s use of any of the Art as permitted under this Agreement infringes or otherwise violates the rights of any third party, you agree to indemnify and hold Glasschord harmless from any claims or demands, including attorneys’ fees and costs, incurred by Glasschord with respect thereto.

All art and content on the Site are either owned or licensed by Glasschord and may not be reproduced or used in any manner without the express written permission of Glasschord and, if appropriate, the relevant artist and/or owner. Other Terms
If any provision of this Agreement shall be unlawful, void or unenforceable for any reason, the other provisions (and any partially enforceable provision) shall not be affected thereby and shall remain valid and enforceable to the maximum possible extent. You agree that this Agreement and any other agreements referenced herein may be assigned by Glasschord in its sole discretion, to a third party in the event of a change in Glasschord’s form of business entity, or a merger or acquisition. You agree that by accepting this Agreement, you are also consenting to the terms and practices described in the Glasschord Privacy Statement.
